TERMS AND CONDITIONS

Competition closes at 11:59pm on 25 September 2026

These Terms and Conditions apply to the Family Tree School Challenge (the Competition) promoted by Fabrik Limited (the Promoter) in connection with Stan Walker and Stan Walker: The Symphonic Experience.

By entering the Competition, the entrant, their school and, where applicable, their parent or legal guardian agree to be bound by these Terms and Conditions.

1. THE COMPETITION

1.1 The Competition gives eligible New Zealand schools and their currently enrolled students the opportunity to submit a performance of Family Tree for the chance to perform the song live on stage with Stan Walker as part of The Symphonic Experience.

1.2 Two winning schools will be selected:

  • one winning school from the North Island; and

  • one winning school from the South Island.

1.3 The North Island winning school will have the opportunity to perform with Stan Walker at Trusts Arena, Auckland.

1.4 The South Island winning school will have the opportunity to perform with Stan Walker at Wolfbrook Arena, Christchurch.

2. ELIGIBILITY

2.1 The Competition is open to students currently enrolled at a registered New Zealand:

  • primary school;

  • intermediate school; or

  • secondary school.

2.2 All students participating in an entry must be currently enrolled at the school represented by that entry at the time the entry is submitted.

2.3 Each entry must feature a group of between 5 and 20 currently enrolled students from the same school.

2.4 Each school may submit more than one entry, provided each entry is a separate performance and complies with these Terms and Conditions.

3. HOW TO ENTER

3.1 To enter the Competition, an eligible group must:

  1. Get together a group of 5–20 currently enrolled students from the same school.

  2. Perform Family Tree in their own style.

  3. Film the performance.

  4. Upload the video to Instagram, TikTok or Facebook.

  5. Tag @StanWalker.

  6. Include #FamilyTree and #StanWalkerSymphonicExperience in the post.

  7. Ensure the account used to submit the entry is public for the duration of the Competition.

3.2 Entries must be posted between the opening of the Competition and 11:59pm on 25 September 2026.

3.3 The person submitting the entry must have permission from the relevant school to enter the Competition on behalf of the participating students.

3.4 Where an entry includes students under 18 years of age, the person submitting the entry and/or the school is responsible for ensuring that all necessary parent or legal guardian permissions have been obtained before the entry is submitted.

3.5 Entry is free. No purchase is required.

3.6 The Promoter is not responsible for entries that are lost, late, incomplete, corrupted, incorrectly submitted or unable to be accessed.

3.7 An entry must remain publicly accessible until the Competition has been judged.

4. ENTRY REQUIREMENTS

4.1 Each entry must:

  • be an original performance of Family Tree by the participating students;

  • feature between 5 and 20 students;

  • feature students who are currently enrolled at the school represented by the entry;

  • be submitted through Instagram, TikTok or Facebook;

  • tag @StanWalker;

  • use #FamilyTree;

  • use #StanWalkerSymphonicExperience; and

  • be submitted before the Competition closes.

4.2 Entries must not contain material that is unlawful, defamatory, obscene, threatening, discriminatory or otherwise inappropriate.

4.3 Entries must not contain third-party music, images, video, logos or other material that the entrant does not have permission to use.

4.4 The Promoter reserves the right to exclude any entry that does not comply with these Terms and Conditions.

4.5 The Promoter may contact the person submitting an entry to verify the eligibility of the school or participating students.

5. JUDGING

5.1 Entries will be judged by a panel selected by the Promoter and Stan Walker's team.

5.2 Entries will be judged on:

Performance

The quality and delivery of the performance.

Creativity

How creatively the school has interpreted and presented the song.

Group Energy

The connection, energy and togetherness demonstrated by the students.

Spirit

How well the performance captures the themes and feeling of Family Tree.

Overall Impact

The overall impression and impact of the performance and video.

5.3 The judges will be looking for performances that capture the themes of Family Tree, connection, togetherness, family and community.

5.4 The judges' decision is final, subject to any rights available to entrants under New Zealand law.

5.5 No correspondence will be entered into regarding the judging decision, except where required by law.

6. WINNERS

6.1 Two winning schools will be selected:

  • 1 × North Island school

  • 1 × South Island school

6.2 The winning schools will be contacted using the contact details provided by the person submitting the entry.

6.3 The Promoter may require a winning school to provide reasonable evidence confirming:

  • that the school is eligible;

  • that participating students are currently enrolled at the school;

  • that all required parent or legal guardian consents have been obtained;

  • that the school has authorised participation;

  • that participating students are available for the relevant activities; and

  • that the school agrees to these Terms and Conditions.

6.4 If a winning school cannot be contacted within a reasonable period, does not respond, is found to be ineligible, or is unable to meet the requirements of the prize, the Promoter reserves the right to select another winning school.

7. THE PRIZE

7.1 Each winning school will receive the opportunity for its winning student group to perform Family Tree live on stage with Stan Walker as part of The Symphonic Experience.

7.2 The North Island winner will perform at:

Trusts Arena, Auckland

7.3 The South Island winner will perform at:

Wolfbrook Arena, Christchurch

7.4 The winning students will participate in the performance as part of The Symphonic Experience, subject to production requirements.

7.5 The prize does not include cash.

7.6 Travel, accommodation, meals, transport and other expenses associated with attending the relevant performance are not included unless expressly agreed otherwise in writing by the Promoter.

7.7 The Promoter and Stan Walker's team will determine the final number of students able to participate in the live performance, taking into account venue, production, safety and performance requirements.

7.8 The winning school must ensure participating students are available for any required rehearsal, soundcheck and performance commitments.

7.9 The prize is not transferable or exchangeable for cash.

8. PARENT AND LEGAL GUARDIAN CONSENT

9.1 Because the Competition involves students who may be under 18 years of age, appropriate parent or legal guardian consent must be obtained for each participating student where required.

9.2 Consent must cover, where applicable:

  • participation in the Competition;

  • submission and publication of the entry;

  • participation in the live arena performance;

  • photography and filming;

  • use of the student's image, voice, name and performance;

  • social media publication;

  • publicity and media activity; and

  • use of Competition content for promotional purposes.

9.3 The Promoter may request evidence of consent before a winning school is confirmed or before a student participates in any Competition-related activity.

9.4 If the required consent cannot be obtained for a participating student, the Promoter may require that student to be removed from the relevant Competition activity or performance.

9.5 The Promoter will provide or make available further consent information or documentation where required for the winning schools.

9.6 Parents, legal guardians and students should be given clear information about the purposes for which photographs, video and other personal information may be collected and used.

10. CONTENT AND INTELLECTUAL PROPERTY

10.1 By submitting an entry, the person submitting the entry confirms that:

  • they have the authority to submit the entry;

  • the school has authorised participation;

  • all necessary permissions have been obtained;

  • the entry does not knowingly infringe the rights of another person; and

  • the Promoter's use of the entry in accordance with these Terms and Conditions will not knowingly infringe the rights of another person.

10.2 Entrants retain ownership of their submitted video content.

10.3 By entering the Competition, the entrant grants the Promoter, Stan Walker, Stan Walker's management and relevant event and promotional partners a non-exclusive, worldwide, royalty-free licence to reproduce, publish, communicate, edit, adapt, display, distribute and otherwise use the submitted entry for purposes connected with:

  • the Competition;

  • Family Tree;

  • Stan Walker;

  • The Symphonic Experience;

  • Fabrik and its events;

  • social media;

  • websites;

  • digital advertising;

  • publicity;

  • public relations;

  • media coverage;

  • television;

  • radio;

  • online media; and

  • promotional or archival purposes relating to the Competition or associated events.

10.4 This licence may continue after the Competition has ended.

10.5 The Promoter may edit entries for length, format, technical requirements or promotional purposes.

10.6 The Promoter may repost, share or otherwise publish submitted entries across its own channels and may provide entries to Stan Walker, his management, media partners, event partners and relevant promotional partners.

10.7 The entrant acknowledges that content posted publicly to social media may be viewed, downloaded, copied or shared by third parties outside the control of the Promoter.

11. WINNER CONTENT

11.1 The Promoter and Stan Walker's team may professionally film and photograph Competition activities involving the winning schools, including:

  • the winning school being notified;

  • Stan Walker's surprise visit;

  • Stan Walker performing at the winning school;

  • students rehearsing;

  • soundcheck;

  • backstage activities;

  • the live arena performance; and

  • associated Competition activities.

11.2 Subject to the required permissions and consents, this content may be used for:

  • social media;

  • digital advertising;

  • websites;

  • publicity;

  • public relations;

  • media;

  • television;

  • radio;

  • event promotion;

  • future promotional material; and

  • archival purposes.

11.3 The Promoter will take reasonable steps to ensure that students for whom the required consent has not been obtained are not intentionally included in published Competition content.

12. PRIVACY

12.1 The Promoter may collect personal information in connection with the Competition for purposes including:

  • administering the Competition;

  • verifying eligibility;

  • contacting entrants and winners;

  • arranging Competition activities;

  • arranging the prize;

  • obtaining required permissions and consents;

  • organising filming and photography; and

  • promoting the Competition, Stan Walker and The Symphonic Experience.

12.2 Personal information may include names, contact details, school information, photographs, video recordings and other information reasonably required to administer the Competition.

12.3 Personal information may be shared with Stan Walker, his management, event production personnel, photographers, videographers, media partners and other service providers where reasonably required to administer or promote the Competition.

12.4 The Promoter will handle personal information in accordance with the Privacy Act 2020 and applicable privacy requirements.

12.5 Individuals may request access to, or correction of, personal information held about them, subject to applicable law.

12.6 Where personal information relates to children or young people, the Promoter will take appropriate care when collecting, using and sharing that information.

12.7 Information about photography and filming, including the purposes for which images may be used and shared, will be provided to relevant participants and their parents or legal guardians as part of the consent process.

13. SOCIAL MEDIA

13.1 The Competition is in no way sponsored, endorsed, administered by or associated with Instagram, TikTok or Facebook.

13.2 Entrants release Instagram, TikTok and Facebook from responsibility or liability arising from participation in the Competition to the extent permitted by law.

13.3 Entrants must comply with the applicable terms and conditions of the social media platform used to submit their entry.

14. CHANGES TO THE COMPETITION

14.1 The Promoter reserves the right, where reasonably necessary, to amend, suspend, extend or cancel the Competition or amend these Terms and Conditions.

14.2 The Promoter will not make changes for the purpose of unfairly disadvantaging an entrant.

14.3 If circumstances outside the Promoter's reasonable control prevent the prize from being delivered as described, the Promoter will use reasonable efforts to provide an alternative arrangement of equivalent or comparable value.

14.4 The Promoter will communicate any material changes to the Competition through its relevant communication channels.

15. LIABILITY

15.1 To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage, injury, delay or expense arising from participation in the Competition or acceptance or use of the prize, except to the extent caused by the Promoter's negligence or otherwise cannot lawfully be excluded.

15.2 Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded, restricted or modified under New Zealand law.

15.3 Schools and entrants are responsible for ensuring that participating students have the necessary permissions and are able to safely participate in Competition activities.

15.4 The Promoter is not responsible for circumstances outside its reasonable control that prevent or delay the Competition, school visit or live performance from taking place.

16. DISQUALIFICATION

16.1 The Promoter may disqualify an entry or entrant if:

  • the entry does not comply with these Terms and Conditions;

  • false or misleading information has been provided;

  • required permissions or consents have not been obtained;

  • a participating student is not currently enrolled at the school represented by the entry;

  • the entrant attempts to manipulate or unfairly influence the Competition;

  • the entry contains unlawful or inappropriate content;

  • the entrant does not have the necessary rights or permissions to submit the content; or

  • the Promoter reasonably believes the entrant has acted fraudulently or improperly.

16.2 If a winning entry is subsequently found to be ineligible, the Promoter reserves the right to withdraw the prize and select another winner.

17. GENERAL

17.1 These Terms and Conditions are governed by the laws of New Zealand.

17.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue to apply.

17.3 A failure by the Promoter to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision.

17.4 These Terms and Conditions should be read together with any specific instructions or information published by the Promoter in relation to the Competition.

17.5 The Promoter reserves the right to make reasonable decisions regarding matters not specifically covered by these Terms and Conditions.
